For any privacy question or request, email support@darkless.cloud or open a ticket.
What We Collect
- Account details: your name, email, phone number, address, country, and company name if you give one.
- Billing records: your services, invoices, and payments. PayPal handles your payment details, and we do not store card numbers.
- Security records: sign-in history with IP addresses, and web server logs.
- Support records: your tickets, chat messages, and Discord messages in our support channels.
- Discord details, if you link your account: your Discord user ID and email address.
- Website use: analytics about the pages you visit.
- Verification documents: only if we need to check an order for fraud and ask you for them.
Why We Use It and Our Legal Basis
- To provide your services, take payment, and give support, because it is necessary for our contract with you.
- To keep tax and accounting records, because the law requires it.
- To protect our systems and prevent fraud and abuse, because we have a legitimate interest in keeping our services and customers safe.
- To understand how our website is used and improve it, because we have a legitimate interest in running a useful website.
- To show independent customer reviews on our reviews page, because we have a legitimate interest in helping people decide whether to buy from us.
- To send service messages such as invoices, outage notices, and changes to our policies. We do not send marketing emails.
Do You Have to Give Us Your Data?
We need your account details to create your account and provide a service, and we cannot provide one without them. Our services are for people aged 18 or over. We do not make decisions about you that have legal or similarly significant effects by automated means alone. Fraud checks are carried out by our staff.
Files on Your Service
You decide what you store on your service, and you are responsible for any personal data in it. We process those files only to provide the service. We access them only to give support you asked for, to deal with abuse, or to meet a legal duty. Our Terms of Service set out how we process this data for you.
Who Receives Your Data
We do not sell your personal data. We share it only with these suppliers, and only for what they do for us:
- WhiteSky Hosting: the datacentre in the United States that hosts our servers.
- PayPal: payments.
- Cloudflare: website delivery, security, and bot checks.
- Microsoft: company email.
- IDrive: storage for our backups.
- Discord: support, and account linking if you choose it.
- PostHog: website analytics.
- Chatwoot: website chat.
- Trustpilot: the reviews widget on our reviews page.
We may also share data with advisers, with authorities when the law requires it, or with law enforcement when we report illegal activity on our services.
Where Your Data Comes From
Most of it comes from you. We also receive your Discord details from Discord if you link your account, payment confirmations from PayPal, and security signals from Cloudflare.
Transfers Outside the UK and EU
Our servers are in the United States, and several of the suppliers above process data there. When we transfer personal data outside the UK or EU, we rely on an adequacy decision such as the UK-US data bridge, or on approved safeguards such as standard contractual clauses. You can ask us for details of these safeguards.
How Long We Keep Your Data
We keep personal data only for as long as we need it:
- Account details: while your account is in use, and for 2 years after your last service ends. If you never order a service, 12 months after your last sign-in.
- Invoices and payment records: 6 years from the end of the financial year, as UK tax law requires.
- Support tickets: 3 years after they are closed.
- Sign-in logs: 12 months. Web server logs: up to 30 days. Email delivery logs: 90 days.
- Verification documents, if we ask for them: deleted within 30 days of the check.
- Linked Discord details: until you unlink them or your account is deleted.
- Files on your service: deleted when the service ends. An unpaid service is suspended 2 days after the due date and removed 14 days after it. We do this so that we do not hold customer data for longer than we need to, and so that the resources can be allocated to other customers.
- Backups of VPS files: up to 7 daily and 2 weekly copies, deleted 30 days after the VPS is removed.
- Backups of game server files: up to 7 daily and 4 weekly copies.
- Backups of our own systems, which include billing data: up to 7 daily and 2 weekly copies.
We make backups on a best-effort basis, so please keep your own copies of anything important. You can opt out of VPS backups for a service by emailing support@darkless.cloud. We may keep data for longer if the law requires it or a legal claim is open.
Cookies
Our billing site uses essential cookies for sign-in and security. Our main website uses cookies for analytics (PostHog) and chat (Chatwoot). These only load if you accept them in the cookie banner, and you can change your choice at any time with Cookie settings at the bottom of any page. Our reviews page also shows a Trustpilot widget, which loads when you open that page. Trustpilot receives your IP address and browser details and may set its own cookies, under its own privacy policy.
How We Keep Your Data Safe
We protect your personal data with organisational and technical security measures. However, no electronic transmission over the internet can be guaranteed to be 100% secure.
Your Rights
You have the right to access your personal data, correct it, ask us to delete it, restrict how we use it, object to how we use it, and receive a copy in a portable format. Some of these rights have limits. For example, we must keep invoices for the period above.
To use any of these rights, including asking us to delete your data or account, email support@darkless.cloud or open a ticket. We will confirm you own the account and reply within one month.
Complaints
If you are unhappy with how we handle your data, email support@darkless.cloud or open a ticket. We will acknowledge your complaint within 30 days and respond without undue delay. You also have the right to complain to the Information Commissioner's Office at ico.org.uk/make-a-complaint or on 0303 123 1113. If you live in the EU, you can complain to your local data protection authority.
Changes to This Policy
We will update this policy when our practices or the law change, and the date at the top will show the latest version.
