Introduction
These terms outline the rules and regulations for the use of our services and products. Do not order a product or service if you do not agree with the terms and conditions outlined below.
By ordering anything from Darkless, you're immediately bound to these Terms of Service. This document ("terms of service") goes over everything we will and won't do but also sets the standards we have for our platform/customers.
Changes to These Terms
Darkless may review the Terms of Service periodically and may change them by posting the new version on our site. We will email you at least 14 days before an important change takes effect, and you may cancel your service before then if you do not agree to it. Changes needed urgently for legal or security reasons may take effect sooner. Your continued use of the service after a change takes effect will constitute your acceptance of it.
Eligibility of Service
Darkless is defined as a professional service provider and can deny anyone access to our services. You must be at least 18 years old to use our services. When someone ("client", "customer") isn't at least 18 years old or doesn't abide by the laws that apply to them, we may take the non-exhaustive list of actions:
- Termination of your account.
- Termination of your service.
- Discontinued contact and support.
- Refusal of refunds.
Identification Requirements
When purchasing a KVM/VPS from Darkless, you must provide either one of the following documents on request of our support team if your order is marked as fraud and we have reasonable suspicion to suspend your services for investigative purposes:
- Photo ID (e.g., government-issued ID card).
- Company ID (if applicable).
- Driver's License.
- Passport.
- Utility Bill (to verify address).
- Business Card (if applicable).
Failure to provide these documents may result in denial or delay of service.
Return Policy
If you are a consumer in the United Kingdom, or anywhere else local law gives you a right to cancel, you may cancel within 14 days of placing your order, or within any other period that local law gives you. You do not need to give a reason. If you asked us to start your service during this period, we may deduct the value of the service already provided, where the law allows.
Everywhere else, Darkless offers a 48-hour refund policy upon placing your order. To request a refund, you must provide a valid reason for the refund. Please note that a transaction fee may be charged by the payment processing method. No refunds will be granted if the request is made after the 48-hour refund period has passed, and this policy does not apply to recurring invoices.
Refund requests will be processed within 3 days, and the processing time will not be counted as days of used service. Once the refund is complete, you will not be able to purchase any products from us for 3 days to prevent potential abuse. If you have received a refund in the last 60 days, we reserve the right to refuse a new order or, where local law allows, to refuse a further refund.
Limitation of Liability & Disclaimer of Warranties
Darkless is not responsible for any loss of data that may occur. We make backups on a best-effort basis, as described in our Privacy Policy, and we cannot guarantee that a backup will exist or can be restored, so we recommend that you also make your own backups. It is your responsibility to ensure the protection of your data. Darkless will not be liable for protection or privacy of any content transmitted through any ISP, and/or services our users may use.
SERVICES PROVIDED BY DARKLESS ARE OFFERED ON AN "AS IS, AS AVAILABLE" BASIS. DARKLESS SPECIFICALLY DISCLAIMS ANY OTHER WARRANTY, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. UNDER NO CIRCUMSTANCES SHALL DARKLESS BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL, OR INCIDENTAL DAMAGES, EVEN IF DARKLESS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF DARKLESS'S SERVICE TO THE CUSTOMER IS INTERRUPTED OR MALFUNCTIONS FOR ANY REASON, DARKLESS SHALL NOT BE RESPONSIBLE FOR ANY INCOME LOSSES DUE TO DISRUPTION OF SERVICE DURING THE PERIOD OF MALFUNCTION OR INTERRUPTION.
Darkless's total liability to you is limited to the fees you paid us in the 12 months before the claim arose. Nothing in these terms limits your statutory rights, or any liability that cannot legally be limited, such as for death or personal injury caused by negligence, or for fraud.
Legal Rights
Darkless reserves the right to refuse service to any individual or entity for any reason. For legal inquiries, please contact support@darkless.cloud.
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer, you keep any mandatory protections of the country where you live.
Acceptable Use Policy
By using our services, you agree to comply with all laws and refrain from any illegal or abusive activities. This includes, but is not limited to, DDoS attacks, port scanning, crypto mining, bruteforcing, operating Tor exit nodes on our systems, and intentionally disrupting Darkless's network or harming our customers.
We reserve the right to suspend or terminate your service if we determine that your service is being used for any prohibited activities.
We reserve the right to report illegal activity we discover to your local law enforcement or other relevant authorities, and to share the information needed for that report. This includes, but is not limited to, command and control servers, malware or ransomware distribution, botnets, phishing and fraud, stolen data or credentials, child sexual abuse material, and unauthorised access to other systems.
Chargebacks
Any chargebacks or reversed transactions on your invoices will result in the immediate termination of your account and a ban on the use of our services.
Cancellations & Suspensions
If an invoice isn't paid by its due date, your service will be suspended 2 days after that date. If it is still unpaid 14 days after the due date, your service and files will be removed from our system. See our Privacy Policy for how long we keep data and backups.
Your Data
Darkless is not responsible for the content stored on our systems by clients. If illegal material or stolen software is detected on our systems, we reserve the right to terminate the service without notice and without a refund.
Securing Your Server
You are responsible for the security of your VPS or dedicated server, including its configuration, software updates, passwords, and firewall. Darkless is not responsible for loss or damage if your server is hacked or otherwise compromised, unless our own failure caused it. If a compromised server harms others or our network, we may suspend it until it is secured. If you do not feel competent to configure or secure your server, we recommend hiring a system administrator. The BuiltByBit System Administration forum is one example of where to find people who are, or claim to be, specialised in this field. We do not endorse or verify them.
Backups
We automatically back up VPS services as described in our Privacy Policy. You may opt out for a service by emailing support@darkless.cloud. An opt-out applies only to the service you name. If you order a new service, it will be backed up unless you contact us to opt out for it too.
Processing Personal Data for You
When you store personal data on your service, such as your users' accounts or emails, you are the controller and Darkless is your processor. This section is our data processing agreement with you, and it lasts for as long as we hold that data.
- Purpose: we store and back up the data only to provide your service.
- Instructions: we act only on your instructions, which are these terms and how you use the service, unless the law requires otherwise. If it does, we will tell you where we legally can.
- Confidentiality and security: our staff must keep the data confidential, and we protect it with organisational and technical security measures.
- Suppliers: you authorise us to use the suppliers named in our Privacy Policy, including outside the UK and EU. We bind them to equivalent data protection duties, remain responsible for them, and will tell you before adding or replacing one so that you can object.
- Help: we will help you respond to requests from individuals and meet your security, breach, and impact assessment duties, and we will notify you without undue delay of a personal data breach affecting your data.
- Audits: we will give you the information needed to show that we meet these duties, and will allow reasonable audits.
- End of service: we delete your data when your service ends, and backups as described in our Privacy Policy, unless the law requires us to keep it.
